Request for mediation by the University Defensor

Actuation done after the express request from a member or group of the university community in order to solve disagreements and conflicts about universitary issues. The mediation will be initiated when there exists the written consent of the people involved. Agreements reached shall be binding on the parties.

Colectivo solicitante

Any member of the university community.

Requisitos

The University Defensor will initiate the requirement for the resolution of disagreements and conflicts about universitary issues between members from the university community when both implicant people accept its mediation.

Organismo responsable

The University Defensor is the body responsible for ensuring respect for the rights and freedoms of lecturers, students and administrative and services staff, in order to prevent arbitrary actions or situations of defencelessness in the activities of the University's internal bodies.

Their functions are also receive complaints from any member from the academic complaints with a legitimate interest, mediate in disagreements and differences between members or groups of the university community and propose formulas for conciliation or agreement: formulate recommendations, suggestions, warnings and reminders of legal duties in matters in which it has intervened; and, finally, present the annual report to the Senate.

The actions of the University Ombudsman shall not be subject to the imperative mandate of any university body and shall be governed by the principles of independence, impartiality, autonomy and confidentiality.

Plazos

Universitary defensor will transfer the application in a period of five days since the presentation to whom were affected and will gather the written answers in a period of 10 days about the aceptation or not of the mediation.

If the defensor doesn't receive any answer in this period, it will be understood as a rejected mediation. Mediation’s applications won't interrupt the administrative periods.

After the acceptances of the mediation, the Universitary defensor will concede to the differents parts a period of ten days to the allegation’s presentation and convenience documents.

After the finalization of this period, the Universitary defensor will call to the different parts in an appearance three days later, in which they will try the conciliation, with the proposal of compromise formulas for resolving the issues in dispute within a maximum period of 10 days.

The time limits indicated shall be understood to be fixed in working days.

Formas de solicitar
  • Mediation applications will be presented in the Defensor registration office, through a text in which must be represented identificative data from the applicant, its direction notification, the collective in which take part, fact that motivate its petition and people affected and the the claim to use the mediation procedure.
