The Sixth Court of First Instance of Gijón rules in favour of the academic institution in the lawsuit.

The judicial decision taken by the Sixth Court of First Instance of Gijón, dated on 16th December 2011, acknowledges that the land of the Campus of Gijón, located in the Albert Einstein Avenue, belongs to the University of Oviedo.

Due to the controversies generated as regards the celebration of the Black Week in the Campus of Gijón and particularly, with respect to the ownership of the land where such event took place, the University of Oviedo filed a lawsuit against Gijón's city council requesting the land's declaration as University's public domain.

The root cause of the controversy on the land ownership was the disagreement between the different property titles held by both the University of Oviedo and Gijón's city council, the second case they being the result of a decision taken by the Principality of Asturias.

At the same time, this conflict on property titles stemmed from the National State Administration's transfer of the vast lands and buildings belonging then to the Laboral University. Firstly it was given mainly to the University of Oviedo, for the institution's use, by the Order of the then Ministry of Education and Science, dated on 6th November 1986, in which the controversial land was included. Then and on the other hand, it was referred only to the "Laboral University" Secondary School on the occasion of the transfer of jurisdiction competence in terms of Education to the Principality of Asturias, on the Royal Decree 1081/1999 of 30th December.

After a detailed analysis of the precedents and the process of lands and buildings transfer, as well as the subsequent actions in the land register system, the register and the reconnaissance of the already mentioned property and its soundness and probative value for property reconnaissance purposes, the judicial decision of the Sixth Court of First Instance of Gijón concludes that the ownership of the land belongs to the University of Oviedo.
